Phil Gartside & Sammy Lee Among 11 Summonsed to Court

Bolton Wanderers and a number of representatives will appear at Newcastle Magistrates' Court on February 25, answering to allegations of perjury and fraud.

The allegations relate to the £1million transfer of Gavin McCann from Aston Villa to Bolton in June 2007, in which football agent Tony McGill claims he was wrongfully cut out of the deal after Wanderers hired sports agency SEM to oversee the formalities - costing him a commission payment of up to £390,000.

Last September, Wanderers chairman Phil Gartside and the club as a whole were found not guilty in a civil case at Manchester Civil Justice Centre, with McGill being ordered to pay 80% of the court costs accrued by the Trotters and 30% of those from SEM.

After taking his case to the Court of Appeal, McGill is now pursuing a private prosecution, prompting court summonses to be issued to Wanderers, Gartside, McCann, secretary Simon Marland, former director of football Frank McParland and ex-manager Sammy Lee - among others.

When approached for comment by The Bolton News, Gartside admitted he would continue to deny any unlawful activity.

"We will be robustly defending ourselves against any allegations and deny any wrongdoing again," he said.

Summonses have also been issued to SEM, their CEO Jerome Anderson, as well as football agents Jeffrey Weston, Stephen Horner and David Sheron.

In an official statement, SEM lawyers said: "SEM and Jerome Anderson are aware that a private prosecution has been commenced by Tony McGill and that summonses have been issued.

"Mr McGill's allegations apparently arise from claims made by him against SEM and Mr Anderson in a case which was heard in the Manchester Mercantile Court last year.

"Mr McGill's claims were found to be without foundation and were dismissed.

"The allegations are baseless and will be defended robustly."

McCann went on to make 88 appearances over the course of a four-year spell with Bolton, scoring three goals - two of which came in UEFA Cup competition.
